RENTAL AGREEMENT – TERMS & CONDITIONS CONTRACT
No confirmed booking will be in force prior to the full completion and agreement of the rental agreement. This agreement replaces and supersedes all prior agreements, whether oral or written. All subject matter pertaining to the rental agreement must be contained within this agreement and any changes agreed upon must be in writing within the agreement or hereto annexed.
PAYMENT The deposit paid in securing the booking of the apartment becomes non-refundable should the contract be cancelled within 30 days of the booking date in terms of occupation of the rental unit. All rental payments due must by remitted upon arrival, the non payment of the fees and rental monies, within the times contained herein will deem the contract cancelled, null and void and the refund terms as described shall become applicable.
NUMBER OF OCCUPANTS According to the marketing and promotional advertisements provided for the unit in question, the number of occupants shall not exceed the amount of mentioned sleeping places within the rented apartment, as advertised. The owner or appointed agent has the right to refuse entry or evict the entire party if the number of persons occupying the unit exceeds the number of persons allowed as stipulated within this contract.
EXPENSES TO BE PAID AT EXTRA COST The rental property and listed services, as specifically included in writing by Knightsbridge Property Management Services are included in the agreed upon rental price, as contained in the contract. The normal usage of gas, water and electricity is also included unless specifically excluded in writing by Knightsbridge Property Management Services. Additional services may be included or excluded accordingly, and these will be stipulated in writing hereto annexed, these services may include, but are not limited to, cleaning services, telephone, utilities, linens, heating and/or personal services such as a maid or personal chef. All services included in this rental contract, and the rental price, will be listed accordingly by Knightsbridge Property Management Services, in writing.
OCCUPATIONAL VOUCHER Prior to taking occupation of the rental unit agreed upon, Knightsbridge Property Management Services will provide the client an occupation voucher as well as all additional information required for the occupancy of the unit. Such communication and voucher issue will take place no less than 14 days prior to the occupation / booking date of the unit.
ARRIVAL AND DEPARTURE TIMES The stipulated time of arrival at the rental unit is between 14h00 and 19h00 on the day arrival, as per the agreed booking date. The rental property must be vacated no later than 10h00 on the departure date, as agreed upon in the booking dates. Any alterations or variations of these times must be agreed upon by both parties and stipulated in writing.
PROMOTIONAL AND ADVERTISMENT INFORMATION Knightsbridge Property Management Services has taken all reasonable care and precautions in providing as much information in their rental advertisements and promotional information. As much information pertaining to the rental properties, the ancillary amenities and services are included in this promotional material as possible. However, the promotional material and/or advertisements or any descriptions contained therein do not form the basis of any terms or conditions of this or any rental contract. Knightsbridge Property Management Services shall not be held liable for any differences in opinion in terms of the conditions of the property, surrounding areas, quality of the properties or any temporary stoppages or defects of any utilities whatsoever. Properties advertised and described may differ from published pictures, due to normal wear and tear or changing in furnishings and this may have resulted from changes after promotional and advertising materials were prepared.
COMPLAINTS AND PROBLEM NOTIFICATION The occupant of the rental unit shall inform the owner of the unit or duly appointed manager within 24 hours of a problem occurring. The occupant and/or client shall also notify Knightsbridge Property Management Services within 48 hours should this problem not be reasonably remedied or resolved. Sufficient and reasonable timing should be allowed for the owner or manager to remedy such problem or allocate a suitable replacement accommodation and/or unit, vacating the premises without explicit authorization by Knightsbridge Property Management Services will not be deemed sufficient or adequate cause for a refund or any reimbursement whatsoever. The onus and responsibility remains with the occupant and/or client to duly inform Knightsbridge Property Management Services of any complaint arising and with regard to the rental unit, and reasonable time must be allowed for the solution or remedy of the problem identified, during the rental period. Failure of such problem reporting, as described, will void and nullify any claim following the expiration of the rental period and agreement. The occupant and / or client is fully aware of the differences within Panama pertaining to cultural, architectural, economical and natural aspects of the regional environment, that may differ slightly or vastly from other parts of the world.

CHANGES AND/OR CANCELLATIONS BY UNIT OWNER OR KNIGHTSBRIDGE INVESTMENT GROUP S.A. The owner of the rental unit and Knightsbridge Investment Group s.a. reserve the right to cancel or modify this agreement in any such case that is deemed necessary, as a result of occurrences beyond the influence and control of Knightsbridge Investment Group s.a. and/or the owner of the unit. In the event of a cancellation Knightsbridge Investment Group s.a. shall immediately notify the client and seek to address the change or cancellation in a suitable manner, which may include, but not limited to, a substitution or alternative accommodation premises or property. The client will have the choice of accepting the new property as well as the additional or lesser rental and/or contractual amounts or Knightsbridge Investment Group s.a. will refund the client accordingly. Knightsbridge Investment Group s.a. liability is limited to a monies pertaining to the rental and/or services agreement alone on a pro rated basis and in no way will Knightsbridge Investment Group s.a. be liable for additional travel, alternative accommodation or other related expenses.
LIABILITY The client is aware of and accepts that Knightsbridge Investment Group s.a. may not own the specific rental property, or any other property and acts as a duly appointed agent for the registered owner of the property in question. Therefore Knightsbridge Investment Group s.a. shall not be held liable or responsible for any accident, loss, damage, injury, death or inconvenience suffered or arising from the rental unit and its occupation, except if the occurrence is a result of the direct negligence of Knightsbridge Investment Group s.a. or that of any of the employees of Knightsbridge Investment Group s.a..
Any claims arising from the accident, loss, damage, injury, death or inconvenience are acknowledged and accepted to be between the client and/or occupant and the registered owner of the rental unit. Knightsbridge Investment Group s.a. will not be held liable or accept such liability for the loss, damage, injury or death caused by weather conditions, riots, public violence, health issues or any occurrence beyond its immediate control or influence.
JURISDICTION The client and/or occupant and Knightsbridge Investment Group s.a. agree that this contract is governed and enforceable according to the current laws of the Republic of Panama. Exclusive jurisdiction over all disputes arising under this contract will be addressed by the courts of the Republic of Panama and located within the Republic of Panama.
